This page contains information on the complaints procedure that companies must set up to fulfill their due diligence obligation according to the Supply Chain Act. It does not contain any information on the request for official action in accordance with Section 14 Paragraph 1 No. 2 LkSG.

Why should complaints procedures be established?

Complaints procedures are a core element of due diligence obligations. Every company must have a complaints procedure through which internal and external persons can report human rights or environmental risks or violations in its own business area and supply chain.

Complaints procedures serve as an early warning system through which problems are identified and ideally resolved before people or the environment are actually harmed. In addition, effective complaints procedures provide access to appropriate remedies when needed. If hints or complaints are received about imminent or actual violations and these are confirmed, the company must take remedial action to prevent, end or at least minimize these violations. Companies must then take preventive measures to prevent further violations of the same kind or minimize the risk of them.

The due diligence process described in the LkSG are therefore closely interlinked and intended to mutually reinforce each other. Complaints procedures offer companies the ability to receive feedback on the effectiveness of their risk management and individual due diligence process. They form an important component in the further development of risk management and due diligence process.

When must the complaints procedure be accessible?

Companies that fall within the scope of the law from 1 January 2023 must have a functioning complaints procedure in place by that date.

For companies that fall under the law from the beginning of 2024, this will apply from 1 January 2024.
