European Union Law/Embargo Measures

Democratic Republic of Congo

The Council Regulation (European Union) 2016/1165 of 18 July 2016 (Official Journal of the European Union L 193 of 19.7.2015, page 15) amending Regulation (European Community) Number 1183/2005 imposing certain specific restrictive measures directed against persons acting in violation of the arms embargo with regard to the Democratic Republic of the Congo amended the criteria for the designation of persons and entities to be subject to restrictive measures set out in paragraphs 9 and 11 of Resolution 1807 (2008) of the United Nations Security Council.

With the above legal instrument the European Union implements the Resolution 2293 (2016) adopted by the United Nations Security Council on 21 June 2016. 

North Korea

The Corrigendum to Commission Implementing Regulation (European Union) 2016/780 of 19 May 2016 amending Council Regulation (European Community) Number 329/2007 concerning restrictive measures against the Democratic People’s Republic of Korea (Official Journal of the European Union L 151 of 8.6.2016, page 125) corrected supplements and amendments of Annex V to Regulation (European Community) Number 329/2007 which are contained in Regulation (European Union) 2016/780.

The Council Implementing Regulation (European Union) 2016/1127 of 12 July 2016 (Official Journal of the European Union L 188 of 13.7.2016, page 1) implementing Article 2 (3) of Regulation (European Union) Number 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Implementing Regulation (European Union) 2015/2425 revised the list of persons, groups and entities who are subject to Regulation (European Community) Number 2580/2001. 

Al Qaida and ISIL (Da´esh)

With the Commission Implementing Regulations (European Union) 2016/1018, (European Union) 2016/1063, (European Union) 2016/1113 and (European Union) 2016/1186 of 23 June 2016 (Official Journal of the European Union L 166 of 24.6.2016, page 5), 30 June 2016 (Official Journal of the European Union L 177 of 1.7.2016, page 4), 8 July 2016 (Official Journal of the European Union L 186 of 9.7.2016, page 9) and 20 July 2016 (Official Journal of the European Union L 196 of 21.7.2016, page 44) amending for the 246th, 247th, 248th and 249th times Regulation (European Community) Number 881/2002 concerning certain specific restrictive measures directed against certain persons and entities associated with ISIL (Da’esh) and the Al-Qaida network, three persons were deleted and the identifying information related to eight persons was amended in the list of persons, groups and entities subject to the freezing of funds and economic resources as set out in Annex I to Regulation (European Community) Number 881/2002.

The amendments implement the resolutions adopted by the Sanctions Committee of the United Nations Security Council on 20 and 24 June, and on 5 and 15 July 2016.

Information Leaflet on „Technology Transfer and Non-Proliferation“ published

The Information Leaflet “Technology Transfer and Non-Proliferation – A Guide for Industry and Academia“ was updated. The Leaflet contains substantial information on the issue of technology transfer that is very relevant in practice and deals with technology transfer by electronic media. The Leaflet is published at the Federal Office for Economic Affairs and Export Control ’s web site.

Information Leaflet „Export Control for Spare Parts listed in Annex I to European Community Dual-Use Regulation“ published

The Leaflet „Export Control for Spare Parts of Annex I to European Community Dual-Use regulation – Efficient Assessment and Simplified Procedures“ takes up another topic of practical relevance, namely simplified procedures for the export of spare parts. It illustrates different simplified procedures that may be used for the export of spare parts listed in Annex I to the European Community Dual-Use Regulation. The leaflet is available at the Federal Office for Economic Affairs and Export Control ’s web site. 

German-Chinese Export Control Forum on 26 September 2016 at Fleming’s Conference Hotel Frankfurt

Within the bilateral cooperation supported by the Federal Foreign Office the German-Chinese Export Control Forum will be held in Frankfurt on 26 September 2016. Representatives from China (Foreign Ministry and Ministry of Commerce) and Germany (Foreign Office, Federal Ministry for Economic Affairs and Energy and the Federal Office for Economic Affairs and Export Control ) will inform on the joint efforts undertaken by Germany and China in the field of export control/non-proliferation, on trends and recent developments in these areas as well as on internal risk and compliance management. The Federal Office for Economic Affairs and Export Control – BIS Conference / Export Control and Compliance Update 2016 on 11 October 2016 at Mövenpick Hotel Frankfurt City

To many companies established in Germany, not only European and German export control laws may be pertinent. They could also be affected by US legislation. Many companies established in Germany do not only reflect European and German export control laws in their internal compliance systems. The risks arising from non-compliance with US (re-)export control legislation make it necessary for them to familiarize with the export administration regulations and the Commerce Control List.

Therefore, the Federal Office for Economic Affairs and Export Control (the Federal Office for Economic Affairs and Export Control ) has also invited the Bureau of Industry and Security (BIS) in 2016 to provide information about the current status of the United States export control reform, recent trends and on-site controls. We are happy to welcome again as a keynote speaker Assistant Secretary Kevin Wolf, a political mentor and detailed connoisseur of the US reform. As in the previous years, representatives of BIS and the Federal Office for Economic Affairs and Export Control will report about legal and procedural amendments in addition.
