The September Issue of Newsletter Export Control has been published.
With the Commission Implementing Regulation (European Union) 2016/1398 of 19 August 2016 (Official Journal of the European Union L 227 of 20.8.2016, page 1) amending Council Regulation (European Community) Number 1210/2003 concerning certain specific restrictions on economic and financial relations with Iraq, two entities were deleted from the list in Annex III to Regulation (European Community) Number 1210/2003. Annex III lists persons of the previous government of Iraq and public bodies, corporations and entities whose funds and economic resources, that were located outside Iraq on or after 22 May 2003, had been frozen (compare Article 4 (1) of Regulation (European Community) Number 1210/2003). A different question is whether funds or economic resources may be made available to these persons or public bodies. Under Article 4 (3) Regulation (European Community) Number 1210/2003, the prohibition to provide funds applies to persons, corporations and entities referred to in Annex IV to Regulation (European Community) Number 1210/2003. This prohibition to make funds or economic resources available under Article 4 (3) does, however, not apply to persons, corporations and entities that are only listed in Annex III to this regulation.
The amendments implement the resolutions adopted by the sanctions committee of the United Nations Security Council on 12 August 2016.
The Commission Implementing Regulation (European Union) 2016/1375 of 29 July 2016 (Official Journal of the European Union L 221 of 16.8.2016, page 1) amending Regulation (European Union) Number 267/2012 concerning restrictive measures against Iran revised the Annexes I, III and VIIB to Regulation (European Union) Number 267/2012. The goods listed in Annexes I and III were supplemented with information allowing a better identification of the items by reference to existing identifying codes as applied under Annex I to Regulation (European Community) Number 428/2009 (European Community Dual-use regulation). However, this expansion does not involve any amendments of the content of Annexes I and III. On the other hand, eight entries in number 2 of Annex VIIB were deleted.
With the Council Implementing Regulation (European Union) 2016/1334 of 4 August 2016 (Official Journal of the European Union L 212 of 5.8.2016, page 3) Implementing Article 21 (2) of Regulation (European Union) 2016/44 concerning restrictive measures in view of the situation in Libya, identifying information related to two persons in Annex III to Regulation (European Union) 2016/44 was redrafted.
The Council Regulation (European Union) 2016/1333 of 4 August 2016 amending Council Regulation (European Community) Number 329/2007 concerning restrictive measures against the Democratic People’s Republic of Korea (Official Journal of the European Union L 212 of 5.8.2016, page 1), published a list of additional goods to which prohibitions on the transfer, procurement and provision of technical assistance apply (‘sensitive goods list’ Ig). These are weapons-of-mass-destruction-related items, materials, equipment, goods and technology.
With the Commission Implementing Regulation (European Union) 2016/1347 of 8 August 2016 (Official Journal of the European Union L 214 of 9.8.2016, page 12) and (European Union) 2016/1430 of 26 August 2016 (Official Journal of the European Union L 232 of 27.8.2016, page 6) amending for the 250th and 251st time Regulation (European Community) Number 881/2002 concerning certain specific restrictive measures directed against certain persons and entities associated with ISIL (Da’esh) and the Al-Qaida network, two natural persons were added and one entry was amended in the list of persons, groups and entities subject to the freezing of funds and economic resources as set out in Annex I to Regulation (European Community) Number 881/2002.
The amendments implement the resolutions adopted by the Sanctions Committee of the United Nations Security Council on 3 and 22 August 2016.
